AVENUE; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE (REQUESTED BY CITY MANAGER KENNIE HOBBS, JR.).

Seeking consideration for the approval of a Resolution, granting an additional time to the amortization period for Akron Industries, LLC.
Need Summary Explanation/ Background:
On March 29, 2021, the City adopted an ordinance amortizing "Automotive Uses" along NW 31 Avenue by March 29, 2026 (21O-03-107). The property owner, Akron Industries, LLC, engages in Automotive Uses, but the City can't furnish proof that the property owner received noticed of the amortization until August 22, 2024. A Resolution is now being requested to provide Akron Industries, LLC additional time (5 years from the date that they received the first notice of amortization letter) which effectively extends their amortization period until August 30, 2029 .
Cost Summary/ Fiscal Impact:
The Planning & Zoning Division finds the implementation of this Resolution will not require a budget allocation or expenditure of City funds and concludes it does not have any direct fiscal impact of the City's budget.
