Seeking consideration for the approval of a Resolution, granting an additional time to the amortization period for Aqua Wonderland, LLC, dba Bubbles Carwash.
Need Summary Explanation/ Background:
On March 29, 2021, the City adopted an ordinance amortizing certain "Automotive Uses" along NW 31 Avenue by March 29, 2026 (21O-03-107). The property owner, Aqua Wonderland, LLC engages in Automotive Uses and described themselves as a "Car Wash" was not properly noticed of the amortization until August 22, 2024. A Resolution is now being requested to provide Aqua Wonderland, LLC additional time (5 years from the date that they received the first notice), which effectively extends their amortization period until August 30, 2029.
Cost Summary/ Fiscal Impact:
The Planning & Zoning Division finds the implementation of this Resolution will not require a budget allocation or expenditure of City funds and concludes it does not have any direct fiscal impact of the City's budget.
