RESOLUTION NO. 26R-03-61: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LAUDERHILL, FLORIDA, APPROVING THE FIRST AMENDMENT TO DECLARATION OF USE RESTRICTIONS INVERRARY GOLF COURSE AND CLUBHOUSE LANDS ATTACHED AS EXHIBIT “A” AND THE JOINDER BY GOVERNMENTAL INTEREST (CITY OF LAUDERHILL) IN SUBSTANTIALLY THE SAME FORM AS EXHIBIT “B”; AUTHORIZING THE CITY MANAGER TO EXECUTE THE JOINDER BY GOVERNMENTAL INTEREST (CITY OF LAUDERHILL); PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE (REQUESTED BY CITY MANAGER KENNIE HOBBS, JR.).

Requested Action:
Approve a resolution approving the First Amendment to the "Declaration of Use Restrictions Inverrary Golf Course and Clubhouse Lands" and the Joinder by Governmental Interest and authorize the City Manager to execute the Joinder on behalf of the City.
Need Summary Explanation/ Background:
For the past several years, the Inverrary Association, Inc., Concord Wilshire, and the developer, in coordination with community leaders have been discussing a plan of redevelopment that involves revitalizing the Inverrary Golf Course Property that will include redeveloping a portion of the Golf Course Property. The Golf Course Property is subject to certain recreational covenants originally adopted in 1971 that need to be amended to realize this revitalization plan for the Inverrary Community. The Original Declaration can be amended by the affirmative vote of not less than two-thirds (2/3) of the land area described in the Original Declaration. The City has a real property interest of approximately sixty-one acres in the land and therefore has a voting interest in the property. By agreeing to the First Amendment and Joinder, the City is allowing the restrictions to be lifted so that the property can be redeveloped.
