Request Action:
Amend the Code of Ordinances to allow board members to continue serving beyond the expiration of their term until a replacement member is approved.
Need Summary Explanation/ Background:
Currently, when a Commissioner’s term expires, all of that Commissioner’s board appointments expire automatically, regardless of the individual board member’s appointment term. Those board members may continue serving for up to 60 days, with the expectation that the newly elected Commissioner will either appoint a new board member or formally retain the existing appointee.
We have encountered situations, however, where a Commissioner does not select a new board appointee but also does not formally approve retaining the previous appointee. This can leave the board in a state of uncertainty. After the 60-day period, the existing board member should be removed, but the resulting vacancy may prevent the board from establishing a quorum and conducting its business.
The proposed amendments would allow a previously appointed board member whose appointment has expired - whether due to the natural expiration of the appointment term or the expiration of the appointing Commissioner’s term - to continue serving until the appointing Commissioner makes a new appointment.
