Request Action:
Requesting consideration of a text amendment to the Code of Ordinances & Land Development Regulations (LDR) to relocate and update the fee schedule for the various applications reviewed by the Planning & Zoning Department.
Need:
The proposed fees have been calculated based on the estimated time it may take the average application to be reviewed by various staff members to process an application. Fees have been updated to consider the entire process for approval of all potential types of projects.
Summary Explanation/ Background:
Staff has prepared an amendment to the Land Development Regulations to amend the fee schedule. Staff is proposing that applications processed by the Planning & Zoning Department be established to off-set the estimated cost for staff to review and process. On January 25, 2010, the City Commission approved Ordinance 10O-01-103, which adopted the existing Planning and Zoning Review fee schedule. Since then, development applications and operating costs have increased. The existing Planning and Zoning fees are in the City’s Code of Ordinances, Chapter 6 Building and Building Regulations, Section 6-10. Enumeration of Permits fees, regulations and inspections fees which includes Planning and Zoning Review fees as well as Building fees. Staff is recommending to move the Planning and Zoning Review fees to the Land Development Code as a more suitable location for these fees, and update various sections of the code that make reference to the fee schedule in Section 6-10 of the Code of Ordinances.
The proposed fee updates would result in an increase to the majority of administrative fees. A fee comparison indicating the existing and proposed fees is attached as part of the Development Review Report (DRR). For example: A Variance Zoning fee would increase from $1,000 to $1,425, this is a 43% increase. This is due to the staff time it actually takes to review the application, provide comments, draft notifications, prepare staff report for Boards and Commission approval.
The item was considered by the Planning & Zoning Board at the Meeting held on April 30, 2024. The Board recommended approval to the City Commission with a vote of 5-1.
