RESOLUTION NO. 26R-08-148: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LAUDERHILL, FLORIDA, APPROVING THE FOURTH AMENDMENT TO THE SOLID WASTE COLLECTION AND HAULING SERVICES AND THE RECYCLING COLLECTION SERVICES FRANCHISE AGREEMENT BETWEEN THE CITY OF LAUDERHILL AND WASTE MANAGEMENT, INC. OF FLORIDA (“CONTRACTOR”) TO EXTEND THE TERM OF THE FRANCHISE AGREEMENT FOR AN ADDITIONAL ONE (1) YEAR PERIOD COMMENCING OCTOBER 1, 2026 AND EXPIRING SEPTEMBER 30, 2027 SUBJECT TO TERMINATION UPON NINETY (90) DAYS NOTICE TO CONTRACTOR; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE (REQUESTED BY CITY MANAGER KENNIE HOBBS, JR.).

Request Action:
Pass a Resolution to extend the Franchise Agreement for an additional one (1) year term. The extension of the Agreement shall commence on October 1, 2026 and expire on September 30, 2027 with the option to extend an additional one (1) year periods upon mutual written agreement of both the City and the Contractor.
Need Summary Explanation/ Background:
The City and the Contractor executed a Third Amendment Franchise Agreement in 2025 which extended the Agreement for an additional one (1) year term commencing on October 1, 2025 and due to expire on September 30, 2026.
The City issued Request for Proposal (RFP) for Solid Waste Collections and Hauling Services which will remain open until November 11, 2026. In order to ensure continuity of service and to ensure the best rates available in the procurement process, the city is seeking to extend the Franchise Agreement for another year and as provided in the Third Amendment, the City and Contractor agree to extend the Agreement for an additional one (1) year term. The extension of the Agreement shall commence on October 1, 2026 and expire on September 30, 2027.
The City may extend the Agreement for additional one (1) year periods upon mutual written agreement of both the City and the Contractor. The City may terminate for convenience this Agreement and any renewal upon ninety (90) days’ notice to the Contractor.
This extension is subject to the current annual Consumer Price Index (CPI) of WST capped at 5% plus the pass-through disposal increase.
All other provisions of the Franchise Agreement as amended remain unchanged and in effect. In the event of a conflict between the Franchise Agreement, Solid Waste Agreement, Recycling Agreement, bid documents, First Amendment, Second Amendment, Third Amendment, and Fourth Amendment shall control as to the term only.
