RESOLUTION NO. 25R-06-111: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LAUDERHILL APPROVING THE 2025 AMENDED AND RESTATED TRANSPORTATION SYSTEM SURTAX INTERLOCAL AGREEMENT (THIRD AMENDMENT), WITH BROWARD COUNTY, SUBSTANTIALLY IN THE FORM ATTACHED AS EXHIBIT “A” AND INCORPORATED HEREIN; AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT AND THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE (REQUESTED BY CITY MANAGER KENNIE HOBBS, JR.).

Request Action:
It is requested that the City Commission approve the amendments and to restate the Interlocal Agreement, in its entirety.
Need Summary Explanation/ Background:
This 2025 Amended and Restated Transportation System Surtax Interlocal Agreement (“2025 ILA”) is entered into among Broward County, a political subdivision of the State of Florida (“County”), the municipalities that formally approved and are a party to the Transportation System Surtax Interlocal Agreement that was executed by County on August 29, 2018, and such additional municipalities that are signatories to this 2025 ILA (collectively, the “Municipalities” and each a “Municipality”), and the Broward County City Managers’ Association, Inc. (“BCCMA”). County, Municipalities, and the BCCMA are each a “Party,” and collectively referred to as the “Parties.”
The Transportation Surtax funding; (iv) will allow Municipalities the ability to obtain Transportation Surtax funding to be used as required local match in relation to state and federal appropriations and grants; to streamline the manner by which projects funded by the Transportation Surtax are placed under Surtax Funding Agreements; to provide Municipalities with flexibility on how each will use Formula-based Funding from the Transportation Surtax; to permit multiple Municipalities to collaborate on the joint management of their Community Shuttle programs; to permit the ILA to be more easily modified, if and as required, to more efficiently and effectively distribute the Transportation Surtax Proceeds committed to Municipalities; and to describe the role that the BCCMA will have in connection with certain parts of the programs established between County and Municipalities.
