ORDINANCE NO. 20O-01-101: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF LAUDERHILL APPROVING THE PURCHASE AND SALE AGREEMENT BETWEEN THE CITY OF LAUDERHILL AND FLORIDA PUBLIC UTILITIES CO. FOR THE CITY OF LAUDERHILL TO PURCHASE A PORTION OF A PARCEL OF LAND IN EXCHANGE FOR VARIOUS CONCESSIONS WITH NO MONETARY EXCHANGE, AS STATED IN THE AGREEMENT, ON THE PROPERTY DESCRIBED IN THE EXHIBITS; ACCEPTING THE DEED TO THE DESIGNATED PARCEL; AUTHORIZING THE CITY MANAGER AND/OR HIS DESIGNEE TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS; PROVIDING FOR AN EFFECTIVE DATE (REQUESTED BY CITY MANAGER, CHARLES FARANDA).

Request Action:
Approve and accept the deed for a portion of a parcel of land as indicated and approving the "purchase" in exchange for the various concessions indicated with no monetary exchange.
Need:
To obtain title to certain portions of property the city has been utilizing and to return access to private owner's portion of land they are requesting.
Summary Explanation/ Background:
This ordinance will give the City an Easement to allow the City to have continuous access to the use of the water plant property in perpetuity. The City of Lauderhill over the years has installed improvements and utilities on certain parcels of land owned by Florida Public Utilities Co. near the city water plant. Homeland Security is requiring Florida Public Utilities Co. to install certain fencing and safety measures around its natural gas facility. In exchange for the City installing the necessary fencing, Florida Public Utilities Co. is giving a portion of the road and parcel to the City, at no cost, and is giving an easement for a portion of the parcel of land for the City to be able to continue to have access to and use of the property on which the city water plant sits, which is not owned by the City.
