RESOLUTION NO. 21R-07-143: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LAUDERHILL APPROVING THE 70th WEEKLY EXTENSION OF THE DECLARATION OF A STATE OF EMERGENCY IN THE CITY OF LAUDERHILL REGARDING COVID-19 EFFECTIVE THROUGH JULY 20, 2021; PROVIDING FOR AN EFFECTIVE DATE (REQUESTED BY CITY MANAGER DESORAE GILES-SMITH).

Request Action:

Pass a Resolution approving the 70th weekly extension of the Declaration of a State of Emergency in the City of Lauderhill regarding COVID-19 effective through July 20, 2021.

 

Need:

SB 2006 now requires that all extensions of Declarations of State of Emergency be voted for approval by the governing body.

 

Summary Explanation/ Background:

The Florida Legislature recently passed SB 2006 regarding Emergency Management amending Florida Statutes, Section 252.38(4)(c) effective July 1, 2021 and which now requires that any State of Emergency Order (other than those issued in response to hurricanes or other weather-related emergencies) must be approved by the majority vote of the governing body, cannot exceed 7 days in length, and cannot expand over more than a total duration of 42 days.  As a result, this statute supersedes our City Code Emergency Section 8 1/2 -3 which previously authorized the City Manager to execute such Emergency Orders.
