Request Action:
Requesting consideration of a text amendment to the Land Development Regulations (LDR) to revise the methodology for staff to measure distances between tobacco stores from other uses.

Need:
A business owner has requested consideration of this item by the City Commission in order to allow their business to be located closer than 1,000 linear feet from the entrance of a city park.

Summary Explanation/ Background:
Staff has prepared an amendment to the Land Development Regulations to amend the method by which staff assesses the minimum distance between tobacco stores from schools and parks. Currently the adopted regulations require that all separation requirements be measured “shortest airline measurement” from property line to property line, unless otherwise mentioned in the Code. Alcoholic beverage uses are an example where the measurement method is unique. The method of measuring distances between new alcoholic beverage establishments from other existing alcoholic establishments, schools and parks is the: “shortest route of ordinary pedestrian travel along the public thoroughfare.” The amendment clarifies the methodology to measure distances for alcoholic beverage uses and establishes a new methodology for tobacco store.
