Request Action:
Pass an Ordinance to correct typographical errors and to make distance require provisions consistent with state law as contained in Florida Statutes, Section 381.986.
Need:
To amend distance requirements consistent with State law and to correct typograpical errors.
Summary Explanation/ Background:
Florida Statutes, Section 381.986 contains state preemption provisions which specifically address the types of entities that distance requirements are permitted to be set from and also provide that medical marijuan dispensing centers must be regulated in the same manner with the same distance requirements and licensing fees applied to pharmacies licensed under Florida Statutes, Chapter 465. These changes to the ordinace are consistent with the provisions contained in the Florida Statutes and correct minor typograpical errors.
